This text is a draft of general terms and conditions prepared for the website. It should be reviewed by the company's legal representative before publication.
1. Introductory Provisions
These general terms and conditions (hereinafter referred to as the "GTC") govern the relations between the company Kovosmetana s.r.o., Uherčice 328, 691 62 Uherčice, ID: 05307198 · VAT number: CZ05307198 (hereinafter referred to as the "supplier") and its customers for the supply of prefabricated halls, steel structures, construction works and related services (CNC firing, steel blasting). The General Terms and Conditions are an integral part of every work contract or purchase contract concluded between the supplier and the customer, unless the contract stipulates otherwise.
2. Offer and conclusion of the contract
Product information and indicative prices on the website are not an offer to conclude a contract. The supplier's price offer is valid for the period specified in it, otherwise 30 days. The contract is created by signing the contract for the work, or by written confirmation of the order by the supplier.
3. Price and payment terms
The price of the work is agreed in the contract. Unless otherwise agreed, the price is paid in advance according to the schedule in the contract and the remaining part after handover of the work. Invoices are payable within the period indicated on the invoice. Ownership of the delivered parts of the work passes to the customer upon full payment of the price.
4. Term of performance
The term of performance is specified in the contract and is calculated from the fulfillment of the customer's cooperation (handover of the construction site, documents, permits, payment of the deposit). The term is reasonably extended by the time during which it was not possible to fulfill due to reasons on the part of the customer, due to force majeure or adverse climatic conditions preventing the execution of the work.
5. Customer cooperation
The customer shall ensure access to the construction site, connection to energy, necessary permits and decisions, if they are not the subject of delivery, and timely approval of documentation. Changes to the specification after the start of production may mean a change in price and date; the contractor will calculate them before execution.
6. Handing over and taking over
The work is transmitted by protocol. Obvious defects are noted in the handover protocol; minor defects and incompleteness that do not prevent use are not a reason to refuse acceptance.
7. Warranty and liability for defects
The supplier provides a warranty for the work for the duration agreed in the contract, but at least 60 months for the steel structure, unless otherwise agreed. The warranty does not cover defects caused by improper use, intervention by a third party, failure to perform prescribed maintenance or force majeure. Defects must be claimed in writing without undue delay after discovery.
8. Withdrawal from the contract
Each of the parties may withdraw from the contract in the cases established by law and the contract, especially in the event of a significant breach of the other party's obligations that has not been rectified even within a reasonable additional period.
9. Protection of personal data
The processing of personal data is regulated Personal data protection policy.
10. Final Provisions
Legal relations are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. If the customer is a consumer, he can file a complaint with the Czech Trade Inspection (coi.cz). These GTC are effective from September 1, 2026.
